   India is a country having diverse religions and cultures. It becomes necessary to harmonize industrial relations in the country with respect to such diversity. India’s trade performance during 2003–04 was influenced by a number of factors which include productivity changes in the manufacturing sector, recovery of global economy and world trade, continued trade promotion and trade facilitation efforts of the government, and an appreciating Indian Rupee against the US dollar. Hence India has a wide variety of labour laws which are essential for the smooth functioning of industrial relations in the country. In today’s developing world IT has played an important role to formulate it into a new height. IT plays a role like a magnet, at one pole it is positively charged and the other is negatively charged. As such its magnetic field helps some aspects of life and affects some aspects of life. One of the most critical needs of the burgeoning Indian software industry and other outsourcing service providers is to have the flexibility and the independence to hire the most worthy of the manpower and fire the unproductive employees. There is also a growing need to draw a fine balance between the hire and fire policy of the employer and the rights of the workmen. This article proposes to discuss the Indian retrenchment laws, right of compensation of employees and applicability of these laws to Indian Information Technology (the “IT”) industry

MEANING-

Information Technology (IT) in a broad sense connotes that technology which is connected with information. More particularly it connotes that technology which has taken shape during the last five decades or so involving electronics.  THE Indian IT industry is among the country’s fastest growing sectors. India has been able to establish itself as a competitive and quality destination for outsourcing IT & IT enabled services.

The Information Technology Enabled Services (ITES) sector is spreading in India fast, and over five lakh workers and technicians are employed in it. We welcome the development of this sector as it is providing gainful employment to educated persons in India. Several centres in India have developed a large number of call centres and consultancy offices, which are earning enormous profits. Their number is likely to swell very fast in the near future. Accordingly to uphold the network of information technology in India IT Act came into force in 2000.

The use of such technology for the storage, retrieval and dissemination of information has given rise to several legal, social and ethical problems.

We the world citizens are breathing in a very much insecure society with the increasing dimensions of newer techniques of creating nuisance, terror and ever increasing distrust among citizens world over. Bombs in the bus, train, cinema theatre, open market areas, aero planes and also lying on the garbage tins are only few exhibits of a few peoples’ hatred towards the progressive nations; innocent lives are becoming items of rampage. These inhuman acts are the outcome of free breeding corruption of excessively selfish, narrowly greedy and anti social persons widely distributed throughout the globe. Our irresponsible political leadership has fathered and faithfully nurtured these values for quite sometime, well above four decades. Even In India, we are now only preachers of peace but have always supported criminals and masked their inhuman acts as part and parcel of democracy. We were theoretically known as symbols of tolerance but as a national character now, we display complaints and dissatisfaction on every issue; we are said to believe in “forget and forgive”, but our instinct of taking revenge never calms down. This dualism of Indian practices has been most vividly viable for more than Fifty years; though said to be prevalent in all periods of human civilization. And this dualism or even pluralism of split personalities is rampant world over among all politicians, everywhere thus a common man is becoming an easy victim. This is principally on account of ever increasing economy at any and every cost and this global feature is the motive dogma of modern progress. To be honest in approach, economic progress is friendly to ethical values only in the beginning but soon becomes a bookish conjecture.

The new format of the society is non palatable to millions of simple, honest and humble citizens who believe in brotherhood, love to all human beings and duty as the foremost human religion: those who believe in second religion is an option of thoughts and way of life !!. I have counted heart beats of such people spread world over by way of personal talk, involving and sharing mutual respect.

Exhibition of hatred in the form of terrorism is the latest edition of quelling human values, feelings and ambitions of being a human being. Variable techniques of generating terror are continuously questioning our technological progress dependent-perversions. And the bitter truth is that we can never achieve perfect, clean and honest society. Not because such a society never existed anywhere but because, biologically, this is improbable, impossible and definitely imaginative. Perverts are always born, socially transformed /made, nurtured, and have always been “domesticated” by power.

Industrialisation and Nigeria's 2020 Goals

Just days after the announcement and even before the survey could be launched, the Manufacturers Association of Nigeria came out with a startling report identifying 37 companies that had closed down across the country over a space of just two weeks. The report once again confirms the bitter state of affairs of the Nigerian economy, where closures are a frequent and constant refrain. A complete account of contemporary Nigerian industry is in fact impossible without a mention of the de-industrialisation that continues to plague it. Just another point of irony in the great ‘Nigerian Paradox’ of acute economic backwardness in a situation of abundant natural and human resources!

The collapse of world oil markets in the early 1980s skewered Nigeria’s foreign exchange reserves and practically stalled economic growth. The cumulative effect of years of incoherent policies further upset the country’s fragile international and domestic fiscal condition, causing massive inflation, unemployment and poverty. Nigeria’s standing as a middle-income country was thoroughly humiliated, and by the 1990s, it was confirmed as one of the poorest in the world. An even more demeaning fall in average living standards accompanied the loss of national fortunes.

The economic downslide proved especially harsh on the manufacturing sector, partly at least due to the over-dependence on oil exports that thwarted economic diversification. With local sourcing of raw material confined to all but a few industries, capacity utilisation plunged dramatically in import-dependent operations. Nigerian manufacturing is predominantly about isolated assembly-line functions with very limited or no backward connections to the economy. These and other factors combined to bring the total GDP contribution from manufacturing down from a little over 9% in 1981 to 6% by the end of the last century.

The renewal of democratic governance in 1999 was followed by an enthusiastic redirection of development policies. Abuja quickly announced multiple programmes to achieve a stable and globally aggressive economy that is not critically dependent on the oil and gas sector. The crux of the government’s new ambitions were outlined with the adoption of the 2020 goals, a radical vision document that foresees Nigeria as one of the 20 top world economies by that year. While there are no comprehensive progress reports yet, some international aid and monitoring agencies are ambiguous about the eventual fate of this grand scheme. Others, like the IMF, are confident that Nigeria will not only achieve its goals, but will do so despite the current global financial crisis. In July, a visiting IMF team reaffirmed optimism about rapid growth and economic diversification, insisting however on the importance of a macroeconomic policy conducive to private sector growth.

What Nigeria effectively needs are policies fostering rapid business development across sectors: In other words, an enterprise revolution that accelerates sustainable growth while simultaneously helping alleviate poverty and improve living standards. Deputy Prime Minister and the National Party Leader

John Duncan Anderson became interested in politics as a member of the local chapter of the National Party of Australia (NSW) while he was a farmer and grazier. Twenty six years ago Anderson was selected to run for the chair of Paterson, however, major up to the selection the chair was eliminated. Infiltrations

The one thing Targeted Individuals have to understand is the concept of Infiltration. This means that agents, hired operatives, civillian informants, etc will try to infiltrate your organizations or your life.

I recently posted an article about Infiltration of online groups. This has been happening for some time now. Many people think if they are posting online that they will not be investigated, but there are infiltrators who try to engage posters in conversations, where they get them to say things against the government, or use talk of violence, something that might not happen without the provocateur. These individuals are on most of the popular forums, and often you won’t know who they are. You might get a sense of who they are based on their postings, but that is not always the case.

These types of infiltrations are happening all over the Internet. Sometimes the poster will just be observing gathering information and monitoring. In other cases they will perform a similar fuction to their offline components, and they will engage posters in extreme conversations about violence, anti-government sentiments, etc.

When J.Edgar Hoover ran the FBI, the infiltration of the KKK was about 20% infiltration. The agents that had infiltrated the FBI were often responsible for encouraging acts of violence on others, or enacting those acts of violence themselves.

Setting up a Company in Turkey

With the passage of the Foreign Direct Investment Law in 2003, the process of establishing a company in Turkey has become a lot easier. Foreign nationals may now become shareholders of Turkish companies with no capital investment requirement and are allowed to establish any type of entity available under Turkish law. Depending on the type and size of your company, there are many incentives available to encourage inward investments. For instance, the Turkish Board of Ministers has recently passed a decision that would allow for customs tax and VAT immunity, as well as a substantial reduction in the corporate tax for newly established companies that creates jobs in certain areas of Turkey. We have provided general information and listed the required documents for formation of a company, branch or liaison office in Turkey below.

Company

There are two types of companies that could be established: a Limited Liability Company (LLC) and a Joint-Stock Company. Both types of entities have a legal identity. The minimum paid in capital for a LLC is 5,000 TL and requires at least 2 founders (maximum 50). For a Joint-Stock Company, the paid in capital is 50,000 TL and requires at least 5 founders. It should be noted that the paid in capital for both types of companies are not immediately due at incorporation; 1/4 of the capital is required within 3 months after establishment and the remainder within 3 years. To register for a LLC, we would have to lodge a petition to the provincial trade registration office, and for a Joint-Stock Company, the registration process would have to be done with the Ministry of Industry and Trade. The current corporate tax in Turkey is a flat rate of 20%.

Some Required Establishment Documents

1) Articles of Association
2) Letter petitioning for establishment and notice signed by company’s representative
3) Notarized signatures of company’s representative with the company’s trade name
4) Letter of Commitment
5) Bank receipt showing a deposit of 0.04% of the company’s capital
6) Notarized copies of the passport, ID and residence certificates (for Turkish citizens) of the founders of the company
7) Certificate of Activity if there is a foreign shareholder legal entity, approved by the Turkish Consulate (with apostilled and notarized translation)

Branch Office

A branch office does not have a separate legal identity as it is seen as an extension of a foreign company. Any income originating from the branch is taxed by the Turkish government as a non-resident company. To establish a branch, your company would have to gain permission from the Ministry of Trade and Commerce and register with the regional Trade Registry Office.

Ministry of Trade and Commerce Required Documents

1) Letter issued by the company or its representative. The letter must include the following:

  • Name of Establishing Company
  • Date of Incorporation
  • Nationality
  • Amount of stated capital
  • Name, Last Name, Address and nationality of the company’s representative in Turkey (appointed for the branch)
  • Legal Undertaking indicating that the representative shall abide by Turkish laws and regulations

Tar Sand "Geocide" – What Actions Should be Taken to Reduce their Environmental Damage?

Oil production in the Alberta tar sands is drastically damaging the Earth through scarring its crust, polluting its waters, and heavily polluting its atmosphere. Many scientists and organizations along with the First Nations chiefs are urging the Government to halt the production of tar sands due to its large environmental damage that contributes to the harming of wildlife and the jeopardy of human health and safety.

Facts

The tar sands are an area containing a vast supply of oil found in the form of tar. Canada’s tar sands are primarily  located in there major reserves: the Athabasca tar sands, the Cold Lake reserves in north-eastern Alberta, and the Peace River deposits located in western Alberta. Together, Canada’s oil sands cover 140000 square kilometres, an area greater than the total land area of England, and have proven to be able to supply 175 billion barrels of oil. Though the tar sands are greatly profitable for British Petroleum and the Canadian Government, the environmental damage is undoubtedly very large and can permanently scar the Earth’s crust as 3350 square kilometres of the tar sands must be obtained by mining the surface of the Earth. Furthermore, the process that refines the oil requires a lot of power and has to be filtered with fresh water which is then contaminated and leached into destructive tailing ponds, a process which has been proven to increase respiratory diseases and cancers in downstream First Nations’ populations.

*In addition, scientists have proven that producing a single barrel of oil from the tar sands produces three times greater gas emissions than a barrel of conventional oil.*

Organizations such as Greenpeace, along with NASA scientists and the First Nations peoples of Canada, strongly urge the Canadian Government to stop the extraction of oil from Alberta’s tar sands as it can stop Canada from reaching its obligations under the international Kyoto protocol and can eventually jeopardize the survival of the human species. Scientists along with Al Gore warn that extraction of oil from Alberta’s tar sands could risk the survival of the human species and unless human kind radically changes from carbon-based fuels, the world may be headed towards Armageddon. Despite the fact that Canada’s tar sand reserves provide 16% of the world’s oil supply, 4 tonnes of landscape must be torn up in order to obtain one barrel of oil, and over 13 million litres of toxic water are being released into the environment by factories. Leading scientists from NASA believe that the federal government should draw policy over water pollution in order to significantly reduce the environmental damage of tar sand extraction, and that it should rely on conventional oil extraction and renewable non-carbon sources instead  Throughout the past several years, the Canadian Government has only invested $1 billion towards creating technologies that are environmentally-friendly and carbon-free such as solar and wind technologies. UKRAINE TRY TO ATTRACT OIL AND GAS INVESTORS – BUT LACK INFRASTRUCTURE TO DO SO

A National Oil and Gas Asset and Exploration & Production Database for Ukraine is a Critical Infrastructure element to attract Investors

Introduction

In order to Ukraine to attract Investors and companies to assist them in the efforts of exploring and producing oil and gas, several steps need to be taken.

One of the most important steps is to make the Energy Sector more transparent to the global players within the oil and gas industry.

There are certainly other steps in this process, such as regulations, laws and fiscal regime that needs to be focused at. However, given that there are large enough opportunities, there will be an international interest, and will give Ukraine more and better cards to play with to close deals in the future.

Ukraine needs to look into how they form partnerships in the future. Not only look at the immediate income of a project, but to look at the long-term opportunity to harvest profits, in several areas.

Ukraine has a large and prominent academic base to take from, and its intellectual base provide Ukraine with a large potential to create a domestic governmental agency to form its future Strategy for oil and gas.

Ukraine also host several industry segments that will benefit from more coordinated oil and gas efforts guided by a national strategy that is sound and transparent to the investors. Rig and pipeline construction and the iron industry cries for more activities apart from its export potential.

In this article the author will touch mostly into the creation of a National Data Center (NDC)/ National E&P Data Bank (NDB), to host and promote Ukraine potential. However, several other activities are touched as well, and should not be seen as less important, although not discussed in details here. These topics should be addressed as equally important.

Background

Ukraine suffers from lack of transparency within the Energy sector today. If Ukraine is to attract serious international and national investors to participate in developing Ukraine’s diversified resources within oil and gas, there is a need to modernize and make the energy sector more transparent on its way.

Encouraging trust and open up the landscape so the investors and government together can resolve the challenges ahead for Ukraine, is the only viable way forward.
